All personal trainers wishing to make use of the Chiswick Fitness Studio are required to sign up to the following terms. More general information for personal trainers is here.

The agreement

This agreement confirms that you, [your name] (herein referred to as ‘The Trainer’), as a self-employed personal trainer, have requested the use of the facilities at Chiswick Fitness Studio for the purpose of personal fitness related training.

This Agreement between ASN Leisure Limited (company number 07089163) trading as Chiswick Fitness Studio (herein referred to as ‘The Studio’) and The Trainer shall take effect from [today's date].

Terms for use of facility

The Studio may change these terms from time to time and so you should check these terms regularly at www.chiswickfitness.co.uk/info-for-trainers/trainer-agreement. Changes to this agreement will also be displayed at The Studio for 30 days from the date of the change. Your continued use of The Studio will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using The Studio.

The Trainer can make use of all equipment within the studio. Additional specialist equipment may be brought into the studio by the trainer, as long as it’s fit for purpose and a suitable risk assessment has been undertaken.

The Trainer will have 24hour access to the facility. All trainers will enter the studio using the main entrances using the entry system.

The Trainer must have and maintain his / her own public liability insurance to provide cover to £2 million, and where required must also ensure he / she is compliant with the requirements of the Phonographic Performance Licence and the Performing Rights Society should you wish to play your own music at The Studio, copies of which should be given to The Studio management.

The Trainer agrees to indemnify The Studio against all cost, claims, actions, demands, penalties and liabilities incurred in respect of or arising in connection with any acts or omissions on the part of The Trainer, or his / her substitute, whatsoever and / or howsoever incurred.

The Trainer must take all reasonable steps to safeguard his / her own health and safety, and that of any other person who may be affected by his / her actions at The Studio. He / She must co-operate with the club so that this requirement can be met. The trainer must familiarise himself / herself with The Studio’s fire safety procedures and policies.

The Trainer must have a current membership of the Register of Exercise Professionals and meet all continuing education requirements of the register on an annual basis. Recognised fitness instructor / personal trainer qualifications will also be required.

As a self-employed personal trainer, The Trainer is personally liable for his / her own pricing, debt collection, tax deductions and national insurance contributions. The Trainer agrees to indemnify The Studio against all cost, claims, actions, demands, penalties and liabilities incurred in respect of or arising in connection with any tax, national insurance or similar or other such payment of a fiscal nature, including any penalties or interest, which may be found due in respect of the provision of The Trainer’s services.

The Trainer shall pay for use of The Studio in advance, of whichever tariff offered by The Studio they choose. Trainers need to book sessions in advance and will be charged their hourly rate if a cancellation is not made at least 24 hours before commencement of the session. Chiswick Fitness Studio has the right to refuse entry to The Trainer if they are not in credit at the time of a session.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

The failure or delay of The Studio to exercise or enforce any right in these terms does not waive The Studio’s right to enforce that right.

These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
